Buyer Disclaimer
1. Purpose of This Disclaimer
This Buyer Disclaimer informs all buyers, investors, enquiry users, and prospective purchasers that Mossco Realty is a land-focused property listing and enquiry platform and not a substitute for legal, financial, technical, or government verification. By browsing listings, contacting listing owners, making enquiries, scheduling site visits, negotiating, or proceeding with any land transaction based on information available through Mossco Realty, you acknowledge and agree to the terms of this Buyer Disclaimer.
2. Platform Scope
Mossco Realty is a land-only real estate listing platform, currently focused on listings such as residential plots, commercial plots, agricultural land, farm land, conversion land, layout sites, investment land parcels, and development land opportunities. Mossco Realty lists land opportunities from across India. It does not function as a legal verifier, title certifier, government authority, or investment guarantor.
3. No Legal Verification by Platform
All property information displayed is based on information submitted by landowners, brokers, developers, channel partners, or other listing representatives. While Mossco Realty may review submissions for completeness, format, and platform suitability, it does not guarantee or certify ownership authenticity, title clarity, legality of land conversion, absence of encumbrances, correctness of survey details, accuracy of approvals, freedom from legal disputes, boundary accuracy, seller authority to sell, or overall investment suitability. Buyers must not treat a listing as a legal endorsement or title confirmation.
4. Buyer Must Conduct Independent Due Diligence
Before making any booking, payment, token advance, agreement, or purchase decision, the buyer must independently verify all important aspects of the land, including:
- Ownership and title documents
- Mother deed / sale deed chain
- Survey number and land boundaries
- Encumbrance certificate
- RTC / mutation / khata / tax records as applicable
- Conversion status or land-use status
- Layout approval / local authority approval where relevant
- Access road and physical approach to the site
- Dimensions, measurements, and land extent
- Zoning or development restrictions
- Pending disputes, claims, family claims, litigation, or government acquisition issues
- Actual possession and physical status of the land
- Seller identity and authority to transact
- Registration readiness and compliance requirements
5. No Guarantee of Accuracy of Listing Information
Listing details may sometimes be incomplete, outdated, changed, or based on seller-provided information that has not been independently verified — including pricing changes, availability status changes, incorrect measurements, inaccurate conversion claims, location approximation issues, unverified approval claims, or seller-side changes in transaction intent. The buyer is solely responsible for independently confirming the current and correct status of any listing.
6. No Guarantee of Investment Return or Appreciation
Any listing, land description, growth-zone mention, or investment-oriented statement should not be interpreted as a promise or guarantee of future price appreciation, resale value, rental or commercial return, investment safety, legal strength of title, or commercial success of the transaction. All land purchases involve financial, legal, regulatory, and market risks. Buyers must make decisions based on their own assessment and professional advice.
7. Site Visits and Physical Verification Are Essential
Buyers should never rely only on online listing content, photos, maps, or verbal discussions. Before proceeding with any purchase, buyers are strongly encouraged to visit the site physically, inspect the approach road and surrounding area, verify exact boundaries and measurements, assess access/topography/physical usability, confirm nearby development claims, and verify whether the land matches the listing description. Mossco Realty shall not be responsible for any mismatch between the physical land condition and listing expectations.
8. Buyer Should Not Make Payment Without Verification
Mossco Realty strongly recommends that buyers do not make token payments, advances, deposits, or part payments solely based on listing visibility, phone conversations, WhatsApp communication, or preliminary assurances without proper verification. Any payment, booking, agreement, or financial commitment made by the buyer is done at the buyer's own risk.
9. Role of Mossco Realty in Transactions
Unless explicitly agreed in writing, Mossco Realty is not a party to the land sale transaction between buyer and seller. The platform's role is generally limited to listing display, enquiry facilitation, and possible coordination support — it is not automatically responsible for drafting agreements, handling registration, negotiating sale terms, confirming title, collecting payment, guaranteeing seller performance, or ensuring transaction completion.
10. Broker / Owner / Developer Representations
If a listing is posted by a broker, developer, channel partner, or other representative, the buyer must independently confirm whether that person is authorized to market the land, whether the landowner has granted consent, whether the quoted terms are genuine, and whether the representations made are documented and reliable. Mossco Realty is not liable for side promises, informal commitments, or commission-related disputes between users and intermediaries.
11. No Liability for Private Dealings Between Users
All negotiations, visits, agreements, payments, promises, commitments, or private dealings between buyers and sellers/brokers/developers are the responsibility of the parties involved. Mossco Realty shall not be liable for fraud or misrepresentation by a seller or broker, title defects, family disputes over land, non-disclosure of encumbrances, failed negotiations, incorrect oral commitments, price disputes, delay in registration, post-sale disputes, or financial losses arising from private transactions.
12. Buyer's Responsibility for Final Decision
The final decision to purchase, negotiate, invest, or proceed with any land transaction lies entirely with the buyer. By using Mossco Realty, the buyer acknowledges that they must rely on independent verification, bear responsibility for legal due diligence, are responsible for professional consultation where needed, and accept the risks inherent in real estate transactions.
13. Recommended Buyer Checklist
Before buying any land listed on Mossco Realty, buyers should ideally complete the following:
- Speak to the owner / listing contact directly
- Obtain copies of title and land documents
- Verify the survey number and land extent
- Check encumbrance and tax records
- Confirm conversion / land-use status
- Visit the property physically
- Verify road access and surrounding developments
- Consult a qualified property lawyer
- Confirm seller identity and sale authority
- Proceed only after satisfactory due diligence
14. Acceptance of Buyer Disclaimer
By using Mossco Realty to search, enquire about, visit, negotiate, or consider any land listing, the buyer acknowledges that they have read, understood, and accepted this Buyer Disclaimer.
